Should Parents Who Use Drugs Lose Custody of Their Children?


The legal (or court) response to drug abuse during child custody proceedings may vary from state to state or situation to situation, but typically begins with a complaint filed about a parent’s suspected drug use and it’s verifiable impact on children involved.

The Department of Child Protective Services typically takes action during these types of custody cases and, if a court adjudicates that a parent’s ability to care for their child is compromised resulting in danger to the child’s well-being (likely involving a previously investigated and determined alcohol and/or drug abuse behavior) then a custody determination is typically made in favor of protecting the child by removing him/her from the environment of drug abuse. Psychological Signs of Drug Use – Most often, the psychological signs of drug use can produce initial indicators such as increased hostility towards others (even friends), anxiety, paranoia, depression, delusions or hallucinations and compulsive cravings.
